What were the major changes to the DWI laws in NJ?

On December 1, 2019, the sentencing provisions of the DWI statute changed significantly. First offenders with a BAC below 0.14% may not be subject to a driver's license suspension, but instead may be required to install an ignition interlock device in their vehicle in lieu of a suspension. The license suspension for second and third DWI offenders were also reduced significantly.

Can you challenge a field sobriety test result?

Field sobriety test results are vulnerable and subject to vigorous challenge. The tests are not reliable if you are over 65 years old or if you have orthopedic problems related to gait and balance. People with equilibrium problem and those wearing high heels also have a basis to challenge the field sobriety results. They are also subject to challenge if the arresting officer did not instruct, and demonstrate, and/or score the tests properly.
