With our firm we have fixed prices that allow us to tell you exactly what that amount would be. To give a price we would need to know more details about whether both spouses are agreeable to settlement terms and if not: (1) what assets/liabilities are being divided; (2) whether anyone is seeking alimony; and (3) the personality of the other person. These details very much determine the price involved. In most instances our clients have something that is “complicated” - whether it be a difficult spouse or a need to value a business or asset/income stream. While we deal with cases with these “aggravating” factors regularly and resolve many of them relatively quickly we find many of our clients have legal fees for these types of cases in the range of $7,500-20,000 if the case is resolved without major court hearings. We can give you a customized fixed price once one of our lawyers understands the specific details of your situation.
Divorce cases can be reopened after a final judgment of divorce in several situations. Child support can be reopened at any time if there is a change in circumstances that would justify modification of child support (usually defined as a change in child support of $50 of 5%). As to seeking support for a disabled child, if the child is under 18 years old it is possible to reopen the case to adjust the child support if the current incomes of the parents and the other factors that go into the child support formula support a change in support of more than $50 or 5% of the current amount. If the child is over 18 this is a more complex issue. It is possible to get child support after age 18 for a disabled child provided certain requirements were met and established prior to the original final judgment.
