I have had the pleasure of observing attorneys Siavash Tourzani and Katarina Long at work over the past several months. With that said, I can honestly say they are the best attorneys out there. They work fast and care about their customers. They are extremely honest with their clients and always keep them updated. Why is my immigration case taking so long?

Unfortunately, many individuals’ cases take longer than they should. Generally, USCIS will adjudicate an individuals case within a specific period of time. The processing times for specific applications can be viewed by checking the process times on the USCIS website by visiting the following link: https://egov.uscis.gov/processing-times/. However, many individuals cases are far past the normal processing times. These long delays can be for multiple reasons. It could be due to the COVID-19 shutdowns. It could be due USCIS further investigating a case as they suspect fraud or other issues with the case. It could simply be that the file is sitting on someone’s desk and immigration has simply not gotten around to processing the application or petition.

What is quicker, a fiancé petition or a marriage-based petition?

There are various factors to consider regarding which petition will lead to a faster result. One factor to consider is whether you are already married or can get married relatively quickly. The time it takes to visit your fiancé and marry them in their home country can further delay the process as a whole, especially given travel restrictions that and border closures that have and could arise due to the covid-19 pandemic. The processing times for each petition can also be the same, but that will depend on which processing center reviews your application. There are other factors you will also need to consider including whether the petitioning spouse is a US Citizen or Lawful Permanent Resident as only US citizens can petition for their fiancés. Ultimately, every individual’s case is different and its important that you discuss your matter with an attorney who can help advise you on what options is best for you.
