It’s a common misconception that having a will means an estate will not need to go through probate. A will's only function is to dictate how assets are distributed during the probate process. In some instances, such as when the asset is owned by a trust, a beneficiary is designated directly on an account, or a Payable on Death designation is on record with the bank, can you avoid probate.
