It depends on your circumstances. If the non-payment is the criminal offense of larceny (i.e. "dine-and-dash", shoplifting, other low-level thefts) the offender will need to be first arrested by the police and then the DA's office can prosecute. If the non-payment is a civil offense (e.g. default on a loan, refusal to pay for services rendered, etc.), then you will need to retain a lawyer or you can attempt to sue in small claims court if the damages amount to $10,000 or less. *This answer is not from a lawyer.
