I was a pedestrian who was hit by a driver while I was in the middle of a pedestrian crossing, which even had its own signal (which was indicating that I had the right of way). According to the accident report put together by the local police, the driver admitted he was aware that I had the right of way and had seen the crossing signal.This driver was then issued an 89-11 crosswalk violation citation. Because of the version of no fault insurance in effect in Massachusetts, in this case the insurance company of the single car involved in the accident was responsible for paying my medical expenses. The auto insurance company's legal competence immediately became a problem and my search for legal credibility ended at the law firm of Mark E. Salomon. The first thing the Mark Salomone lawyers did was schedule a meeting with one of their attorneys. The PIP (Personal Injury Protection), which is part of the Massachusetts No Fault insurance coverage, was explained to me and I signed the PIP form. PIP provides a maximum of $8,000 toward payment of medical expenses and lost salary. I also signed the HIPAA (Health Insurance Portability and Accountability Act) document. HIPAA protects access to "individually identifiable health information". The document I signed allowed my medical information to be released to all parties that needed it pay my medical expenses. My medical expenses were completely paid, almost entirely by the driver's insurance policy. The final version of my medical package was submitted to the same auto insurance policy that had paid 80% of my PIP medical expenses. At this point, after the no fault benefits (primarily PIP) had been exhausted, a bodily injury (BI) claim against the driver's auto insurance comes into play. This is completely separate from the initial PIP claim, as PIP is a no fault benefit and BI is only accessed on a policy when the insured was at fault for the accident. As I understand it, the negotiating process in this case was unusually brief. The auto insurance company's initial offer was the surprisingly generous offer of what they felt was the maximum fair settlement amount.
