The workers’ compensation insurance company is not allowed to deny reasonable medical treatment prescribed by your attending physician. You should get legal assistance to help you get the medical treatment you need. Attorney fees are paid by the workers’ compensation insurance company and consultations are at no cost.

You should confirm with your employer that a claim was actually filed on your behalf. Just as you are required to report all injuries or accidents as soon as they occur, your employer is also required by law to file your claim and notify the insurance company. You should not delay your medical treatment waiting for your employer to file the paperwork. If necessary, the doctor’s office or emergency room can file the claim for you.

Your doctor’s decision that you need additional treatment to improve your condition must be respected by the insurance company.

Settling your claim with an insurance company after an injury is a big decision. Depending on the injury, your entire life and the lives of your family may be affected by your decision. Getting help in understanding your options is a good idea. Attorneys don’t charge for their time in workers’ compensation cases. They only charge if they help settle your case, and then it is a percentage of the settlement.
