In Florida, many cases, and most personal injury cases, are brought by counsel for injury victims who have been retained under contingency fee attorney retainer contracts. These contingent fee contracts typically provide that the attorney will only be paid at the end of a gainful representation of the client. A gainful representation in a personal injury case is usually defined as a monetary recovery for the client. Thus, no upfront expenses are required to retain personal injury counsel.
In court cases all parties typically call one or more witnesses. Before a witness can be deposed or called to testify at a trial, prior notice and opportunity to appear to all parties to the case must be given.
Pursuing a case should not be something that causes fear to an injury victim pursuing a case. Cases with merit should provide relief to an injured person when they are handled correctly and gainfully resolved. Most of the work will be handled by the attorney and attorney’s staff. The injury victim who pursues a claim will likely be required to provide a statement and/or deposition, may be physically examined by an insurance carrier’s doctor(s), and may have to attend a few court proceedings. If the case is meritorious and the injury-victim is honest and forthright throughout the process, there is little for the victim to worry about if represented by an experienced and qualified injury attorney.
