Calling Michael Henderson's office was the best decision I made in 2021! He and his staff were always very professional, patient and compassionate. Due to the concussion I sustained from the accident, patience was very important. It was also the reason I knew I could not deal with all of the ins & outs of insurance companies, by myself. Mr. Henderson knows the path to take at each intersection, making the necessary steps through to completion, seamlessly. I honestly hope to not need his services in the future, but would not hesitate for a moment to call his office if a need did arise. Also highly recommend Mr. Henderson to anyone looking for a kind, knowledgeable & experienced lawyer, who will take you by the hand through each step of the way. Much heart-felt appreciation to Mr. Henderson and his staff.

He had his legal assistant call me to gather a little information about what I experienced. He had her call me back about 20 minutes later to let me know he passed on the case. I have documentation and witnesses that I was subjected to a hostile work environment for months, retaliated against for bringing up safety concerns and company policy violations by my peers. I am also owed for unpaid wages. The legal assistant said he said I gave up certain rights when I resigned (instead of continuing to be retaliated against in an hostile AND unsafe work environment) but that I should pursue a wage claim on my own. THIS IS NOT TRUE. By resigning, I made the case more difficult, I did not give up my rights. I hate excuses. Simply say, “I’m passing on the case because I do not want to take it on.” His legal assistant also stated the wrong statute of limitations on our initial call (I had already looked it up.) she backtracked by saying well,I’m not a lawyer so I’ll have to double check with him. Glad he passed.

Can I be “wrongfully terminated” even if I am an at-will employee?

Yes. At-will employees are still protected from wrongful discrimination and from retaliation for engaging in protected activities, such as filing an injury claim, reporting illegal activity, or exercising protected rights. At-will simply means you do not have a contractual right to continued employment, but you do still have legal protection from being fired for reason that violate the law.

What should I do if I am being harassed at work in CA?

Report the matter to Human Resources and your supervisor (unless they are the one harassing you). Make your report in writing (email or hard copy) and keep a copy for yourself to prove the report was made. Harassment is illegal. However, you must report your concerns to your employer to allow them an opportunity to address the issue. If your concerns are not properly addressed, or you are retaliated against for reporting them, contact an employment law attorney to review your case.

Do all California divorces result in payment of alimony?

No. There are a number of factors: length of marriage and earning level of the two spouses are a couple of the key issues. Longer term marriages where one spouse earns substantially more than the other will often result in an alimony award.

Reaching an agreement with your former spouse is the best way to guarantee you each will get what you want on custody. Sometimes this is not feasible. In that case, a judge will decide custody based on the best interest of the child. This is a fact intensive question that cannot be answered simply. You should consult with an experienced attorney.

If I file a medical malpractice claim, will I have to go to court?

Not necessarily. Many claims are required to submit to binding arbitration instead of a jury trial. Arbitrations are usually conducted before a retired judge. Also, many cases do settle before trial or arbitration. However, unlike other types of injury claims, in a medical malpractice case, the defendant healthcare provider (doctor, nurse, therapist or hospital) and not the insurance company, controls decisions on settlement. This increase the likelihood that a case will have to be resolved by trial or binding arbitration. The reason is that the defendant medical provider has a reputation to protect, plus any settlement of $30,000 or more must be reported by them to the medical licensing board. This makes the defendant reluctant to agree to such settlements, pushing more cases to trial or binding arbitration.

I was seriously injured by a reckless driver. He was not charged and should be. Driver was previously charged/convicted of reckless driving. On probation. Who do i see for justice?

Criminal charging decision are made by the local District Attorney for the county where your injury happened. You can and should press the DA to bring charges. In addition to criminal justice, you have the right to bring a personal injury case in the civil justice system. The goal here is to force the reckless driver to carry the financial burden caused by your injuries. Medical bills, lost wages, physical pain, disability, and emotional harm, are all things for which you can and should be awarded damages. Hiring an experienced personal injury lawyer is the best way to pursue this kind of justice. Most personal injury attorneys will take the case on a contingent fee, meaning they will not be paid unless you win.
