We went in for a issue that initially was not resolved. However after getting the managers attention, we were able to have the car fixed without additional extra cost. They openly admitted their mistake and took steps to make remedy the situation. We appreciate that and hope that it doesn’t happen to others.

I bought a used car from Stevens Creek Toyota dealership a couple of months ago, and I want to share a few things to pay attention to. Be aware of different fees that are being included in the quote. Normal fees are the price of the vehicle, sales tax, and license/title transfer fees. But the dealership also tried to include some additional fees – for example, smog test (which is the responsibility of the seller) and “accessories” line for almost $600 (it was never discussed with me and, as soon as I called it out, it was removed with no further discussion) The dealer also makes you sign the arbitration provision. This was part of the last document I had to sign and no explanation of what rights I am giving up was provided. In essence, by signing this provision as a consumer you are giving up your right to sue the dealer (while dealer still can sue you). You only can resolve a dispute through the mandatory binding arbitration and the arbitration company is chosen by the dealership. A dispute through arbitration almost never ends in favor of the customer. So, basically, a dealer can sell you a lemon car or falsify the information about a car and you cannot sue them. That being said, it is not uncommon practice, and it doesn’t mean that Stevens Creek Toyota was trying to deceive me or was being dishonest about the car. Though there are plenty of dealerships that don't require you to sign the arbitration provision, and it might be a wise choice to work with one of them. What made it deceitful and uncomfortable is that the finance manager Clement Chan was bluntly lying to us saying that the arbitration provision is mandatory by CA law and the contract would not be valid without me signing this part. While in reality CA law is against mandatory arbitration provision and this part of the contract was an addendum that in no way impacted the contract validity. When we asked to speak with his manager over the phone, the manager told us he doesn’t care, and we are welcome to buy the car without signing the provision. Then Clement took over the phone, said one sentence to the manager, immediately hung up, and declared to us the opposite of what we just heard – we will not be able to buy the car without signing the arbitration provision. All we were looking for was an honest explanation (they are mandating this for their own benefit, and it is company policy, not CA law) and a clear response of what our rights and options are. Clement’s behavior was deceitful, dishonest and disrespectful. I still bought the car and eventually signed the arbitration provision since Clement refused to sell the car otherwise. In the future, I will probably walk away and look elsewhere if that happens since it completely ruined our experience and made it hard to trust this dealership overall.
