I reached out to Kevin following a car accident in December of 2020. I was previously turned down by another lawyer I spoke with who felt he could not obtain a successful settlement. In our first conversation, Kevin spent ample time walking me through the process of how to successfully treat my injuries and produce a successful outcome for the case. Kevin's attention to detail and accessibility is what sets him apart from other attorneys. He will spend as much time as you need throughout your case to ensure your needs are met, and that you are in agreement for the next steps. Both Misty and Kevin balanced the needs of my case with the aftermath of Covid and challenges of communicating with staff-shortened medical facilities. They answered all of my questions and regularly informed me of any updates. Kevin and Misty combine the expertise and knowledge of any multi-national firm with the support and care for clients of a small town boutique office. Most importantly, they obtained a settlement amount that far exceeded my expectations. Kevin will fight to get a settlement amount you deserve in the face of stingy insurance companies. These guys are the real deal. I can't thank them enough. They should be your first choice for any personal injury case.

Kevin at Flahavan Law Office is fantastic! We were lucky to find him, he was the first lawyer we called (it was 5pm), the next day we met and we were 100% confident in his ability to take care of us! He went above and beyond for us after a horrible accident. Kevin was always available to answer questions and never made us feel like he was too busy to answer our calls.

Major kudo's and my sincerest appreciation and thankfulness to Kevin and Bill for their incredible support, honesty and professionalism following an accident that took three years to resolve. Kevin communicated often and never rushed our conversations. He was always willing to answer my numerous questions, which was frequent. He worked diligently with doctors and other attorneys and always conveyed the facts to me truthfully. I truly enjoyed working with Kevin and Bill. They always treated me with the highest level of care, compassion and respect. I would refer Flahavan Law Office in a heartbeat to anyone requiring a personal injury attorney. They did an incredible job for me.

Most attorney's will charge 33.3%. However, a lot of law firms may raise that fee to 40% if they have to file a lawsuit. Some will increase it as high as 45% if they get within 30 days of trial.
This question depends on so many factors and every persons case is unique. However, the short answer is that case value depends on the severity of the injuries and the impact that the injury has had on all aspects of your life.
You have 2 years before you have to file a lawsuit. However, if you were in an accident, there’s important steps that need to be taken immediately to ensure a good result.
You typically have 2 years. However, it can depend on the type of case. It is best to contact an attorney immediately.
Yes.
You attorney can help with getting your medical bills lowered so that you end up keeping a larger part of the recovery at the end
Depending on your case, you may not need money. We charge a contingency fee meaning we don’t get paid unless and until you win. Once you win, we get paid out of that money, so you do not need to pay us out of your own pocket.
There are a few options you have. Your best option is to contact an attorney.
Contact the police and have them write a report. Then contact Flahavan Law Offices.
A first party case typically means that you are pursing a claim against your own insurance carrier, not trying to collect from another (3rd party)
If you do not have car insurance and you are not at fault for the accident, you can only recover for your medical bills, lost wages, and property damages. You cannot recover for pain and suffering and loss of enjoyment of life, which is typically the largest portion of your claim. Therefore, most attorneys will not want to take your case.
Sometimes. Hospitals have options and can choose how they would like to be paid.
Your lawyer should be involved in terms of collecting, organizing, outlining, and presenting your medical records to the insurance company in a way to maximize your claim. Additionally, your attorney can retain medical experts to support your case. In some instances, because a lawyer has experience handling injury cases, they may be able to refer you to specialists or other medical providers that they have worked with before if you are having trouble finding a doctor to go to. However, an attorney should not be advising you as to how to treat your injuries or symptoms.
A lawyer may receive an offer to settle your case without you present. However, they must then inform you of the details of that offer. If you agree to accept the terms of that offer to settle the case, your attorney can relay that to the other side. Depending on what your retainer agreement states, your lawyer can either accept the settlement on your behalf, or have you sign a written release of liability. However, in any event you must AGREE to accept the settlement amount in order for a settlement to take place. Your attorney cannot make that decision by himself.
The most important thing to do, after going to the ER or seeking medical attention, is to consult with an experienced PI attorney. If you would like to discuss your potential case, feel free to give us a call at (805) 230-9973.
Hi Elifar, First thing I would do is get treatment immediately. Make sure that a doctor can say with medical certainty that you are getting the headaches as a result of the gas at work. If the gas leak is the fault of your employer, and your employer is responsible for maintaining the premises at work and is failing to do so, then most likely your only remedy will be through making a workers’ comp claim. If this is the case, you should contact a workers’ comp attorney to discuss your potential claim. If your work premises is maintained by someone other than your employer, then perhaps it is something that we can help you with since your potential claim would not be against your employer but a 3rd party. I hope this helps. -Kevin Flahavan
Hi Jack, I’m not sure if you are talking about a car accident that you caused, or a car accident that you were a victim of. However, the number one thing you can do to protect yourself is contact an experienced attorney. If you would like to contact our office I would be more than happy to talk to you more. Generally, either the client or the client's health insurance carrier will pay the bills for medicine. However, these will eventually be reimbursed as part of the settlement when the case is resolved.
