This was an $11M jury verdict against two drug rehabilitation centers for negligence resulting in the death of a 58-year-old male who committed suicide while in their care. The defense team offered as little as 100K even though this was an established family man with a long career in the aerospace field. The jury agreed with us and awarded the widow $11M.
This is a law unique to California and denies the driver to collect damages if he is unisured. Even pain and suffering cannot be collected. This typically does not apply to the passenger but there are always exceptions based on other case law. The driver can however still collect for medical bills.
We have over 40 years representing clients for some of the most catastrophic cases. We have been involved in MetroLink train litigation as well as other commercial vehicle injury cases. We also take Amtrak cases in Los Angeles.
In the past year or so we have been getting inundated by police officers and consumers claiming that their Ford Explorer is causing dizziness and headaches. In more serious cases, police officers have said they had car accidents that were triggered by the carbon monoxide seeping into their vehicle from the exhaust especially when the air conditioning is on. We are taking those cases nationally and advise those affected to immediately take the vehicle to Ford for inspection. In serious cases of injury, keep the vehicle so that an auto defect lawyer can have experts inspect the vehicle.
Governmental claims are subject to special rules. A notice of claim must be filed with the appropriate govermental agency (state, federal, city, county) very soon after the injury. In California that is 180 days.
In California, you are responsible for the injuries and damages you cause in a car accident. If you do not have car insurance, you will be held perosnally liable for the damages and that can affect you in terms of lawsuits against you or your assets. However, if you were injured in a car accident that was caused by the other driver, there may be a few restrictions on what you can recover against that driver, if you don't have an auto insurance policy. California is one of several states that have a "no pay no play" rule. What this means is if you don't have a valid auto insurance policy at the time of the collision, you are limited to what types of compensation you may be able to get.
