Met with Ms Willis today at her office in Orlando. We discussed my slip and fall case and I signed up. Tina Willis was referred to me by a friend of mine who needed a car accident lawyer. I slipped and fell at a hardware store last week. How do I know if I have a case? It was a bad fall and I broke my ankle which will require surgery. Just wondering should I negotiate with them or not?

So whether you have a case against the store depends on several important details, such as how you fell, whether there was any construction defect, or store negligence (like an employee spilling water then not cleaning it up) that caused your fall, and that kind of thing. You have an obligation to report your accident to your own insurance company, or risk losing any coverage you might have. That usually must happen within a short period of time, such as 15 to 30 days for most policies (that can vary; you need to call us ASAP to find out). But even calling your own insurance company can hurt your case if you have something called UM or uninsured motorist coverage. That's one of the reasons you need a lawyer urgently if you were injured. Never talk to the other driver's insurance company. They will use many tricky methods to try to get information to lower the value of your case, such as asking you how the accident happened, how you are feeling, what you are doing, whether you are working now, whether there were any witnesses, the nature of your relationship if a death was involved. Many people say things that they don't realize actually hurt their case in response to these types of questions. The solution is to call us, and have us do the talking

It would be nice if Florida law and insurance policies provided payment to lawyers to pursue vehicle damage claims. Unfortunately, they do not. That means that most lawyers (including us) cannot pursue legal claims unless there is an injury involved. Additionally, we only accept cases where there is a serious and likely permanent injury involved, such as broken bones, surgical cases, herniated discs requiring surgery, spinal cord injuries, traumatic brain injuries (TBI), paralysis, blindness, deafness, tinnitus, quadriplegia, paraplegia, burn injuries, or death. If we cannot accept your case, but you were injured, and we think another Orlando car, truck, or motorcycle injury lawyer could help you, we will refer you to them. We take the obligation to refer you to someone trustworthy very seriously, and Ms. Willis remains obligated on cases she refers to other Orlando personal injury attorneys. There are many factors that determine the value of an Orlando personal injury case. The categories of *available* damages are: past and future medical expenses *caused by* the accident, past and future *provable* lost wages caused by the accident, vehicle damage repair, and pain and suffering. So cases that are lower value are those with fewer medical bills, less serious injuries, and minimal or no lost wages. Also, even with a very serious injury or death case, there might be no value IF the other driver, or responsible party (such as in a premises liability (dangerous property)) case, have no assets, collectible money, or insurance. Many drivers in Florida have low insurance coverage amounts. But, of course, we check the insurance coverage amount. Also, if fault or liability is unclear, then the value of a case will be reduced but not eliminated, as Florida law has a shared responsibility concept built into the law (partial fault = partial financial liability).

The two most important things would be IMMEDIATELY get medical treatment, then call us. Most insurance policies will require that you report the accident to your own insurance company pretty quickly (usually within 15 to 30 days but that can vary by policy). However, ideally, you would talk to us before you call your insurance company, especially if you have "UM" or uninsured motorist vehicle coverage. The reason is that your insurance company WILL be trying to get information from you that could hurt the value of your case. Please do not trust yourself to know what information could hurt your case without calling us. You should never, ever talk to the insurance company for the other driver without a lawyer. Not ever. They will try to get information to hurt the value of your case. And don't ever EVER give a recorded statement without first trying to hire an Orlando car, truck or motorcycle accident lawyer!

The highest value cases are always those involving the most serious injuries, with the "best" facts from a legal perspective. That means that liability (fault) of the defendant is very clear. Also, you have to remember that these awards include medical expenses related to the accident (past and future). So a surgery might cost 100K. Multiple surgeries could be 3 times that amount. Additionally, if someone was earning 100K per year, then was rendered unable to work for the rest of their lives due to an accident, they might have that amount in provable lost wages. Also, if someone required extensive life care, such as caregivers, or home health care for an extended period, those amounts might also increase the case value. In wrongful death cases, there can be a very high value, such as 1 million, for each legal survivor. So if there are more survivors, the value is higher, assuming the defendant has assets, and depending on the nature of those relationships.

We do accept and regularly handle slip and fall cases. However, slip and fall cases are MUCH different than car accident cases in terms of proof, and the amount of damages that one might expect to recover. So we are only able to accept slip and fall cases with certain facts that fit within the parameters of what the law requires. That means we have to ask very detailed questions about where and how you fell. Additionally, we are unable to accept slip and fall cases unless the injuries at least resulted in surgery. This is not the technical legal requirement, as you can technically sue for any injury that resulted from a slip and fall accident. But our threshold as a law firm requires surgery (at least) to consider any slip and fall case. The reason is the amount of time that we spend on each case requires that we only accept more serious slip and fall cases. We also need to be able to show that the property owner did something wrong, such as having a defect on the property.

If you or someone in your family was injured as a result of a car, truck, motorcycle, SUV or bus accident, then you absolutely should consult an Orlando personal injury lawyer. Insurance companies very rarely pay the full amount that they owe to injured vehicle, unless the policy amount is very low, and the injuries are very clearly above the policy value (in which case, you wouldn't get much money anyway -- as most will probably go toward medical bills). On the other hand, insurance companies have MANY tricks up their sleeves with the goal of paying injured people, including their own customers, FAR less money than they are entitled to receive, all with a friendly voice on the other end. They tell many people how much they are supposed to receive, and far too many people believe them. Unfortunately, they usually only offer immediate medical bills, and mention nothing about pain and suffering damages, lost wages, and future medical bills, all of which you are entitled to receive.

We accept all *types* of serious personal injury cases, including slip & fall, premises liability, negligent security, car, truck, motorcycle & SUV accidents, boating accidents, medical malpractice, swimming pool accidents, vacation, resort & hotel accidents. Our limitation is with the seriousness of the accident or personal injury. We are only able to accept cases that involve serious accidents, personal injury, or wrongful death. Our threshold is usually at least 5K in property (vehicle) damage, with at least serious pain and/or emergency surgery afterward. That might include injuries such as broken bones, herniated discs requiring surgery, traumatic brain injuries, spinal cord injuries, paralysis, amputations, regional pain syndrome, shoulder, knee, or hip replacements after accidents, or death cases. If we cannot accept your case, we will refer you to another lawyer we believe has the same high standards for quality service, and Ms. Willis will stay obligated on the case.
