Tom was wonderful throughout the whole chapter 7 bankruptcy process. He answered our questions and gave us peace of mind in a stressful situation. Certain income taxes can be discharged in bankruptcy. There is a three-pronged test that must be met for the taxes in question to be discharged in bankruptcy. 1. The taxes must be more than 3 years old 2. The tax returns must have been filed 2 or more years ago 3. The taxes cannot have been assessed in the last 240 days If the the income taxes in question meet all three prongs of this test, then those taxes are dischargeable in bankrutpcy. This is a very good question. Oregon is considered a "Separate Property" state. Your wife is not liable for your debt, and you are not liable for your wife's debt - in most cases. Now, one exception is if you are both on the contract for the debt; then if one spouse filed bankruptcy, the other spouse will still be liable. But if a credt card, for example, is in your name only, your wife would not be liable for the debt. The one main exception to this rule is for medical debt. Oregon has a law on the books known as the "Family Expense Statute." If one spouse incurs medical debt then the other spouse could be held liable for that debt. In such situations, and depending on how much medical debt there is, I advise that both spouses file bankruptcy together. The benefit of filing a bankruptcy together is that there is only one bankruptcy for both spouses, and the cost is only for one bankruptcy while both spouses receive the benefit of the bankrutpcty discharge.

What is the difference between Chapter 7 Bankrutpcy and Chapter 13 Bankrutpcy?

This is a very good question that I am often asked. Both types of bankrutpcy are considered personal bankruptcy. Chapter 7 bankrutpcy general takes about 90 days from start to finish. Most debts are eliminated through this process, such as medical debt, credit card debt, and other types of consumer debt. There are certain requirements that must be met in order to qualify for Chapter 7. For example, there is a means test based on income and household size. If an individual makes income at a certain level, they may not qualify for Chapter 7 and may need to consider Chapter 13. Chapter 13 is a 3-5 year restructuring of your debt where you make monthly payments. Often, Chapter 13 bankrutpcy is chosen if the client has too high of income to qualify for a Chapter 7. Another reason to choose a Chapter 13 is to stop a foreclosure on your home and pay down the missed mortgage payments over 3-5 years.
