After my car accident, I was scared and being called regularly by the other party's insurance company to accept a settlement while I was still shaken up and seeking physical therapy. I had not worked with a lawyer before and didn't know what I needed. Andrew Pickett was suggested to me, and when I reached out, he spoke directly to me to explain the whole process and listened and understood my fears and concerns. The calls from the insurance company stopped, and I was able to focus on my recovery. Andrew is quite possibly the best attorney I have had the pleasure of meeting. What kinds of attorney fees and costs can I expect to pay if I hire your firm? What if I can’t afford to hire an attorney?

We handle all cases on a contingency fee basis. This means that you will never have to pay any attorney’s fees out-of-pocket. Our fee comes from the settlement at the end of the case. If we are able to settle the case without having to file a lawsuit, our fee is 1/3 of the the total settlement or 33 and 1/3 percent. If we have to file a lawsuit, our fee is 40 percent of the total settlement. We also advance all costs of prosecuting your case. This covers our investigation, hiring experts, filing fees, postage, deposition transcripts, court reporter fees, and any other fees necessary to maximize the value of your case.

Should I just accept the insurance company's offer? I really need the money.

You should always consult with an attorney before you accept a settlement offer from an insurance company. Insurance companies often make “low ball” offers to injured victims who do not have attorneys. An attorney can help you understand the true value of your case, which almost always includes more than your “out-of-pocket” medical bills. An attorney will help you assess the value of past medical expenses, future medical expenses, past lost wages, loss of future earning capacity, and past and future pain and suffering.

A lawyer will help you evaluate and understand all of the elements of damages that you are entitled to under the law. Yes, in the state of Florida, you have four years from the time of the injury to file a lawsuit for negligence. You have two years from the date of death to file a lawsuit for wrongful death. You have five years to bring a contract lawsuit, which includes an uninsured/underinsured motorist lawsuit.

It depends on the attorney you hire. Some attorneys never go to trial. At Andrew Pickett Law we treat every case as if it could possibly go to trial. We leave no stone unturned in our investigation. We have a strong record of success in trial, and the insurance companies know that. Ultimately, the decision to go to trial is up to the client. Your personal injury protection (PIP) benefits will pay 80 percent of your medical bills and 60 percent of your lost wages up to $10,000. Your health insurance may cover the remaining portion of your medical bills, depending on your type of health insurance and your medical provider. Some doctors and facilities will accept a letter of protection, which is a contract between you, the provider, and your attorney. Under a letter of protection (LOP), the provider agrees to be paid out of the settlement proceeds, if there is a settlement. If there is not a settlement, the patient is still responsible to the provider for any unpaid balance.
