Can anyone tell me why I'm having a problem getting my gun back when I have not been convicted of a gun crime. I'm an innocent citizen being violated of my rights to protect myself and possess firearms.

There's more to this that you aren't saying. The only way you wouldn't get your gun back is if you are a felon, it is in evidence of a crime, you have a warrant, or a mental order not allowing you to have it.
