Shouldn't a restaurant tell customers the soda they are serving is "off brand", not bill it as pepsi on the menu, and charge less? Market Diner does not sell real soda but does not tell you that.

Do you know this for fact? How do you know? Anytime you want to accuse a business of wrongdoing, always best to include photos or other evidence, because otherwise, the business could claim you made it up and then sue you for libel. I'm not saying you're right or wrong, since I don't know for a fact if they serve Pepsi or generic cola... But just be wary of the laws that allow people and businesses to defend themselves against libel.
