By the definition of "Upstate NY" if you define downstate NY as NYC and Long Island then yes Harriman is considered upstate as it is not in any of those counties. If, however, you define Upstate by a broader definition - part of Harriman is in Rockland County which is exburb of NYC and thus part of Harriman would be downstate while part would not. If you define it based the federal redistricting case of Rodriguez v. Pataki then no part of Harriman is upstate as it is in Rockland and Orange counties and thus considered downstate as they are served by Metro-North Railroad lines which run near tow several entry points in Harriman.
