It is illegal, and the Tribal Counsel doesn't allow it. If you are trying to prove something legal to the IRS, the counsel can provide you with documents that are considered legally binding, to the I.R.S. specifically! Taking pictures is not considered legal by IRS's standards anyhow, so it is not recommended.

I've taken pictures of a screen while waiting for "service" (answering a question about a payout) so I can keep playing and I've never had the attendant tell me that I wasn't supposed to take a picture. There are no signs posted anywhere that say that you cannot take a picture or video and the only pictures I ever take are of the screen itself not of the casino for privacy Factor. And I'm sure as heck not doing it for the IRS! I just do it too so that I can show my friends as was previously suggested or just so that I can remember which machine later paid me good.

do you really want the irs to see all your wins/losses at casino? If you record video wouldn't you need permission from anyone that is captured on video or audio? If you feel like it's important to record your gambling there are lots of online casinos you can play at home and nobody can tell you no video recording allowed if your home. Unless your married...

I'm pretty sure they have a sign somewhere advising you that video and or photographic recording of events in the casinos prohibited. To be sure, they'll overlook you taking a quick picture of a screen, to show to your friends for example, but that's not going to be a legal document . . . And technically, they can eject you for it. Really, it's your responsibility to be aware of this before you enter the premises.
