A personal injury can be defined as any loss that is physical, mental, or emotional. In law, we use this term to refer to an injury caused due to another negligence.

Each case is different and has a different statute of limitations. For car accidents, the general rule is 2 years after the date of the accident.

There is a long list of recoverable damages. These can be broken down into three categories: 1. Economic 2. Noneconomic 3. Punitive. Economic damages are out-of-pocket costs. These include medical bills, damages to property, lost wages, and more. Noneconomic damages include emotional distress, loss of consortium (in a marriage), anxiety, depression, physical impairment, disability, and disfigurement. Punitive damages are damages intended to deter a particular activity such as drinking and driving, hit & run, fraud, malice, misconduct, and more.

Who can be held liable in a personal injury case and is why it is important to consult an attorney. In an MVA, the at-fault party will first be held liable, you may also be able to recover from resident relatives. If the at-fault party was working or driving a company vehicle, the company could also be liable. Each case requires a thorough investigation of who bears responsibility for a particular action.
