Can a Trust be changed once it is created?

If the Trust is revocable, it may be changed or even terminated. If the Trust is irrevocable, it may still be terminated and changed in certain circumstances. Ideally a Trust should be designed and drafted to provide flexibility to future events to minimize the need to change the Trust, while the terms of the Trust adapt to life's changing situations, provide options for the Trustees and beneficiaries, as well as guidance for the Trustees to monitor and supervise the goals of the creator(s) of the Trust and the needs of the beneficiaries.

If I do not have a will, won't everything I own go to my spouse automatically anyway?

Short answer - NO. In NY, without a will, your spouse would receive a portion and the remainder would be divided in half with your children. If the children are minors, a lengthy and costly Guardianship proceeding may be necessary as well. Call today to make sure your assets are inherited according to your last wishes.
