Kieth Brown is a true professional. He always took the time to understand my difficult circumstances and was always in my corner. My ex's attorney was entirely unresponsive and absent. If it wasn't for Kieth's knowledge, thoroughness and tireless persistence, I would still be waiting. Mr. Brown did all the work and ultimately was successful in getting my divorce through while battling my ex's uncooperative and silent counsel. I must add, he ultimately negotiated a very fair agreement, avoiding many unreasonable requests my ex was demanding. I strongly recommend Kieth Brown and his team. How long does a DWI or DUI case in Harrison Town Court take after an arrest and can my criminal defense lawyer speed up the case?

Any type of DWI, DUI or drunk driving case can take time to resolve in the Harrison Town court or the surrounding courts such as White Plains City Court or Greenburgh Town Court. All of these Courts are prosecuted by the Westchester County District Attorney's Office. The Harrison Town Court is out of the Rye Branch of the DA's Office. A good criminal defense, DWI lawyer will immediately get the mandatory discovery from the DA under the 2020 criminal justice reforms. Once that discovery is obtained our DWI attorneys will email all the documents to our clients for review. After the discovery is reviewed a our DWI lawyers can determine the strength of the case and how to challenge the drunk driving evidence. Plea bargain negotiations are always ongoing. The actual amount of time to resolve the case depends on the complexity of the case. A simple case could resolve in a few weeks while a more complex case can take months. It is highly unlikely a case would take over 9 months.

After a call to CPS, they will respond to the home or agency involving the child or children. A CPS caseworker will arrive sometimes with a police officer. The caseworker will ask you questions and ask to see the child or children involved. They will ask to speak with the child alone and will conduct a visual inspection of the child for injury. The caseworker will also inspect the home or agency. You will be asked to sign releases for medical and school records. The case will be investigated over the course of 60 days. It is a good idea to seek a CPS lawyer or Family Law lawyer to protect your rights as soon as CPS arrives, before you speak with the caseworker. CPS defense lawyers can provide a service to protect your rights. When you are selecting a CPS lawyer choose a lawyer with the experience, staff and resources to fight against false or exaggerated accusations.

No, it generally does not matter if you are the plaintiff or defendant in a divorce action. The plaintiff generally holds the responsibility for moving the case forward, filing documents and drafting final documents. What is more important is the date you file a divorce action as that date is critical for various financial issues in the divorce.

Should I refuse a breathalyzer if pulled over for a DWI?

In a DWI case, if you refuse a breathalyzer (chemical test) in New York State your driver's license is subject to a one year revocation by the DMV. You can challenge that one year revocation by having a refusal hearing before a DMV Administrative Judge. If you win the hearing your license will not be revoked. If you lose you will not be able to drive for a year. If you refuse there is less evidence the prosecution has against you to prove a DWI intoxication. If you take the test there will be more evidence against you but it is easier to stay on the road with a conditional driver's license. Also, if you take the test there is usually a wider range of plea bargains available in court. This is the short answer, for a more detailed answer call us to discuss the case.

You do not have to let CPS in your house unless they have a court order. Sometimes they stop by with the police to look official. Don't let them in. You should not let anyone from the government into your home until you speak with a lawyer first. Call me to discuss.
