Gaara, You cannot get felonies off of your record in Arizona. If it was an undesignated offense, you can petition the court to make it a misdemeanor. Or, you can move to set aside the conviction. A.R.S. §28-138 defines the legal limit in Arizona. The limit of alcoholic intoxication is 0.08 percent or more of blood alcohol concentration (BAC) within 2 hours of driving or being in actual physical control of the vehicle. For commercial drivers, the legal limit is .04 BAC.
Arizona law requires bail for those charged with a felony. The bail hearing is when the defendant is formally notified of the charge and the bail amount is set at a sufficient sum to encourage the defendant to appear in court. Achieving a bail bond is only the beginning of a criminal case and it gets more complicated from there. I encourage you to hire an experienced criminal defense attorney immediately to protect your constitutional rights.
Arizona is a no tolerance state when it comes to driving while impaired. If you were to get pulled over for a minor infraction and the officer smells alcohol on your breath it would give them reasonable suspicion or probable cause. Considered “impaired to the slightest degree,” a couple of drinks can in fact get you arrested for a DUI.
