I couldn't be happier with how my case was handled! Even with all of the confusion caused by COVID-19, I never had a question that Greg and his team couldn't answer almost immediately. Their service is amazing, and they take literally ALL of the stress out of an extremely stressful situation. What type of attorney would I need to make a law suit against my Pain Management Dr.? He did a procedure on me almost 2 months ago, and has done more damage than what was there.

I can recommend a good med mal attorney, but I'd need to know the name of the doctor in case I have a conflict of interests, which could happen if the doctor is treating one of my clients and if I need him to testify in court to support a client's claims. every solution i can think of requires her brother to sign something. If he is not cooperative, the only solution that I can recommend is suing him for fraud, breach of contract and specific performance. Sorry I could not be of more help. - Greg DiLeo

I'm having a problem with either the city of NOLA, the state of LA, DPW or SWB. Not sure yet, none of them know either. I live near N. Robertson Ave. There is a stretch of horrible roadway that is shaking our homes, it feels like and earthquake. WTD?

It depends on who caused the damage, whether you can prove that their activities were negligent and then go from there. There are already several suits against the SWB for damage to homes from drainage projects, but we are not handling those property damage claims, as I specialize in personal injury litigation. Ms. Marshall, thanks for contacting me. I'm not sure what you're asking, but if you had a workers' compensation court approved settlement, and if you signed the papers and the court accepted it by signing the approval order, you can't go back for more. You can always fire your attorney at any time. However, I would caution you against doing that unless you have a new attorney ready to take on your case, which is always difficult after another attorney has had the file for so long. I would suggest a face to face meeting so that you discuss with your attorney your dissatisfaction with him or her and find out what stage your proceedings are in, if it's too late to do anything about it, what fees and expenses are due the attorney, and what your options might be. It may be just that workers' compensation laws only provide very limited relief, and no attorney can make the laws any better than what they are, so it may be simply the nature of WC law. - Greg DiLeo

Mr. Ratcliff, if it's your residence (whether you're the owner or the lease is in your name), you don't need any legal remedy. If anyone is living there without your consent, you have the right to demand that they leave and if they don't, and if they are not paying pursuant to some sort of lease agreement, you have the right to call the police if it is necessary to protect yourself in the process. You have no legal obligation to support a 28 year old or her son. I hope this helped. - Greg DiLeo

Can you make a claim if you was a passenger in someone's car but they were excluded from the insurance?

Ms. Mayfield, if you were injured in an accident as a passenger, you can make a claim against the person who caused the collision. But if the person excluded from insurance coverage was the driver who caused the collision, there would be no coverage for the accident and you could not make that claim. But if the cause of the accident is someone else, just because the driver of your car was excluded, that would not affect your rights to make a claim.
