I can recommend a good med mal attorney, but I'd need to know the name of the doctor in case I have a conflict of interests, which could happen if the doctor is treating one of my clients and if I need him to testify in court to support a client's claims. It depends on who caused the damage, whether you can prove that their activities were negligent and then go from there. There are already several suits against the SWB for damage to homes from drainage projects, but we are not handling those property damage claims, as I specialize in personal injury litigation. I'm not sure what you're asking, but if you had a workers' compensation court approved settlement, and if you signed the papers and the court accepted it by signing the approval order, you can't go back for more. You can always fire your attorney at any time. However, I would caution you against doing that unless you have a new attorney ready to take on your case, which is always difficult after another attorney has had the file for so long. I would suggest a face to face meeting so that you discuss with your attorney your dissatisfaction with him or her and find out what stage your proceedings are in, if it's too late to do anything about it, what fees and expenses are due the attorney, and what your options might be. It may be just that workers' compensation laws only provide very limited relief, and no attorney can make the laws any better than what they are, so it may be simply the nature of WC law. - Greg DiLeo
Mr. Ratcliff, if it's your residence (whether you're the owner or the lease is in your name), you don't need any legal remedy. If anyone is living there without your consent, you have the right to demand that they leave and if they don't, and if they are not paying pursuant to some sort of lease agreement, you have the right to call the police if it is necessary to protect yourself in the process. You have no legal obligation to support a 28 year old or her son. I hope this helped. - Greg DiLeo

Ms. Mayfield, if you were injured in an accident as a passenger, you can make a claim against the person who caused the collision. But if the person excluded from insurance coverage was the driver who caused the collision, there would be no coverage for the accident and you could not make that claim. But if the cause of the accident is someone else, just because the driver of your car was excluded, that would not affect your rights to make a claim.
