Yes, we can most likely help you get your car back. Since it sounds like your car may be evidence in an ongoing investigation, recovering your vehicle may take some time. We can help speed up the return of your property, however. Minnesota vehicle forfeiture laws allow for an “innocent owner” defense. To recover your property, we’ll need to show that you are the rightful owner and you were unaware that your friend would be using your car to violate the law. It depends. In Minnesota, police generally need a search warrant to search your car and you are not required to give them permission. However, if you were legally pulled over during a routine traffic stop, law enforcement only needs probable cause to search your vehicle. But this is where things can get tricky. Keep in mind that speeding, a broken tail light, or merely an officer’s hunch would not be probable cause to search your car. Determining probable cause on the spot when you’re under pressure by police, however, is not something you should be concerned about. Under the 4th amendment, you have the right to refuse search requests.
In short, if you have been charged with possession of drugs in Minnesota, you need to hire a criminal defense attorney. Even if you gave the police permission to be in your home, they may have performed an illegal search and seizure. To accurately answer your question, however, there are various factors that would need to be considered. A face to face consultation would enable us to evaluate your case more thoroughly.
Minnesota drug courts enable eligible people to have access to alcohol and other drug treatment services in lieu of spending extended periods of time behind bars. If you participate in drug court, you can expect close monitoring of your progress toward sobriety. You’ll need to submit to frequent drug and alcohol tests, attend ongoing treatment meetings, court appearances, and meetings with probation officers, and you’ll likely be subjected to extended probation. To opt-in, however, you must plead guilty to your charges.
While you are not required to have a lawyer to plead guilty to a second DWI charge, we highly recommend that you hire an attorney. Since your penalties are based on the severity of your charge, you could face up to $20,000 in fines and up to 10 years behind bars if you’re convicted of a felony DWI. With a lawyer, prosecutors are more likely to make you a better deal. We may be able to get your fines or sentence significantly reduced. Or we may determine that pleading guilty is not in your best interest.
