Actually Montana enjoys a "castle doctrine" style of law. You are well within your rights to use deadly force to end an unlawful threat to: -your life -anothers life -your property UNLESS: -you're doing crime -you're the aggressor/instigator (This was the issue in the Kaarma case. The man left his door open in order to tempt a robber into his home and was found to have purposefully provoked the interaction.) I dont agree with Mr. Hauptmann's interpretation. The law seems to hinge on fear for your safety, the safety of others, and the safety of your property, not whether the person in your home illegally is armed or what you have psychically determined to be their motive for being in your home illegally. In fact, the law specifically states that while protecting an occipied structure, AND other property other than, you are justified in the use of deadly force in order to stop a forcible felony. This by definition includes robbery and burglary. I'm not a lawyer, just my opinion
