I don’t recommend. It was extremely difficult to get in contact with the attorney handling my matter - on average it took two weeks of emailing and calling to get a response. The worst part of all is after approving a petition for filing I found out two months later it was never filed. I only found this out after becoming frustrated with not getting a response from the attorney I decided to call the courts myself to find out the status. The attorney handling my matter continued to tell me the petition was filed and these delays were normal all the while the petition was never filed. No phone call to apologize just a simple email saying they thought it was filed — how can you tell someone a delay is normal without confirming their legal documents have actually been filed (especially when everything is done online)!! Save yourself the headache and seek legal counsel elsewhere.

Although many Bankruptcies are filed to stop collection activity, such as Foreclosure Complaints or Collection Actions that were filed in the Philadelphia County Court of Common Pleas located in City Hall, Bankruptcies are filed in a separate Federal Court. The Federal Bankruptcy Court for The Eastern District of Pennsylvania is located at 900 Market Street, Philadelphia, PA, 19107 and the clerk's office is located on the 4th floor. Our office utilizes online filing with the Bankruptcy Court and for the time being, hearing's are being held telephonically, meaning when using an attorney, a Bankruptcy can be achieved from the comfort and privacy of your home.
An emergency Bankruptcy is generally filed to stop mortgage or tax foreclosure, vehicle repossessions and lawsuits. The emergency petition is filed upon completion of a credit counseling course, filing the Voluntary Petition pages of the Bankruptcy (the first 6 pages), the Creditor Matrix and a Statement of Social Security Number. Our firm can accomplish this task with little notice, however, after the Emergency Petition is filed, the Court sets a 10 day deadline to file the remainder of the Petition known as the "Complete Petition" which can be up to 85 pages in length.
The short answer is, yes. If one spouse is carrying debt or the majority of the debt, that spouse may be desirous of filing a Chapter 7 or Chapter 13 Bankruptcy. A Bankruptcy filing is associated with a social security number and although only the filing spouse's social security number will be listed and associated with the filing, there is other information that is gathered from the non-filing spouse. Bankruptcy involves household income and household expenses. In most cases, for bankruptcy purposes, if a married couple resides together; both of their incomes and expenses would be taken into consideration to determine what chapter of Bankruptcy would be best, even though only one party is filing.
This answer does depend on the Chapter of Bankruptcy, whether a Chapter 7 or Chapter 13 and the complexity of the matter as well, but generally legal fees and costs prior to filing are around $2,000. I have some clients that are financially prepared to file right away. However, most of our clients require flexibility when it comes to legal fees and we have payment plan options that make the investment in a bankruptcy proceeding most affordable.
The amount of debt depends on one's affordability to pay the debt on a monthly basis. Someone may be able to afford to pay towards $15,000 of credit card debt at approximately $500 per month from their disposable income, however someone else may not have $500 of disposable income and needs to consider a Chapter 7 Bankruptcy. Generally, we file Chapter 7 Bankruptcy when there is $10,000 of debt or more.
There is parking available next door at the Holiday Inn Express. The parking fees are reasonable for Center City Philadelphia.
