There are 2 types of burglary charges in California. Residential burglary is when you enter the home of a person with the intent to commit a crime within the home. This crime is extremely serious and you can go to prison for up to 6 years. This crime is also considered a “strike crime” which means if you commit another “strike crime” in the future it can increase your prison sentence for that new crime. The other type of burglary charge in California is a “commercial burglary”. This is a burglary where a person enters a business with the intent to commit a crime within the business. You can be convicted of this crime as a felony or a misdemeanor. As a felony this crime carries up to 3 years in county jail and as a misdemeanor it carries up to one year in county jail.
