My grandma used them to set up a Trust with me as executor and trustee and all the stuff and I've had problems with bank accounts which did get fixed and currently I can't get her cremated through the Omega Society because I don't have the power because the trust apparently wasn't done right it's going to take me thousands of dollars to hunt people down and get things signed so I have approval for it. so no confidence that it's going to stand up in court if I have to go through probate and all that stuff Replying to the reply I am mad at the Omega Society also but please correct me if I'm wrong shouldn't a company that's not following the laws and in compliance be able to be held legally and financially responsible for caused expenses so in the end it shouldn't cost me anything to go after a company that's not following the law and causing unnecessary expenses? PS I will gladly change this review once I find out how a company can violate the law cost me thousands of dollars and get away with it

There are many reasons having an estate plan set up can be beneficial. It makes sure your wishes are respected and carried out when you can no longer care for yourself. It also ensures that your loved ones are taken care of when you pass away.

When the surviving spouse need to have an appraiser or estimated value of the resident , do you need a certified appraiser or real estate agent comps OK ? Which is beneficial for the surviving spouse to get higher comps or lower ?

Dear Agi: This is a very good question. It is important to establish the value of all assets upon a death. For tax purposes it is important to establish the "basis" of the assets for determining capital gains taxes. If property is included in your estate when you pass away then there is an "adjustment in basis" to the current fair market value. So your heirs would not have to pay any capital gains tax. (IRC Section 1014) This is why it is so important not to transfer property before you die. This tax benefit is lost if you do (IRC Section 1015) Generally most people benefit from a high appraisal but if some one has a larger estate subject to estate tax then a lower appraisal may be more beneficial. There are many other considerations that should be discussed with your attorney. Comps are not acceptable to the IRS; you need a formal appraisal.
